Texas non-stunner?

In a surprising move today, the Texas Supreme Court upholds the lower court ruling that the children in the polygamist sect must be returned. Perhaps, since it is freaking Texas, I shouldn't be so surprised. But, here's the key graft of the story that is simply stunning to my sensibilities:

"Under Texas law, children can be taken from their parents if there's a danger to their physical safety, an urgent need for protection and if officials made a reasonable effort to keep the children in their homes. The high court agreed with the appellate court that the seizures fell short of that standard." (bold emphasis added)

What part of rape, even if it's only statutory rape, is not considered a danger to a young woman's physical safety???

Not to mention that apparently, the sect adults could mentally abuse their children to the point where the children readily give in when demanded to have sex with a 45 year old man at the age of say...9. The rubes in Texas clearly, don't get the effect of mental and emotional abuse/coercion at that young age.

How pathetic Texas. You should be ashamed as a "state."
